TERMS OF USE

 

 

Effective as from 20 July 2013

This document (the “Terms”) constitute a legally binding agreement between you and CSR Computers INC. that governs your use of CSR website available at http://csrcomputers.com. In addition to these Terms, you also agree to adhere to the CSR Support System Guidelines (the “Guidelines”) and the CSR Privacy Policy (the “Privacy Policy”) when using the CSR Support System. CSR Support System is a place for discussions, and exchange of information, tips and other materials related to the Hardware and Software Troubleshooting (as defined in the Terms and Conditions of Use). The user can be accessed the following creation of a support tickets in accordance with the instructions provided on the registration page. Please note that you must read and agree to the Terms and the Guidelines before you use the CSR Support System. If you do not agree to the Terms or the Guidelines, you may NOT use the CSR Support System. If you have any questions concerning the CSR Support System, these Terms or the Guidelines, please contact CSR customer service by visiting the contact us section of the website.

1. Contract formation

By using the CSR Support System and/or it's website or services, you confirm that any registration information that you submit to CSR is true, accurate and complete, that you will update such information in order to keep it current, and that you agree to these Terms and the Guidelines. You agree to not include photos, trademarks, trade names, logos or other information that is inappropriate or offensive or that infringes privacy rights or intellectual property rights of CSR or any of its affiliates or group companies, or any third party.

2. Changes to the Terms

CSR may make changes to these Terms at its sole discretion. Any material changes will be communicated to you and your acceptance of and / or continued use of the CSR Support System after such notification of changes to the Terms will constitute your acceptance of such changes.

3. No official support

Information, advice or other material of any kind submitted on the CSR Support System (“Content”) is not official support provided by the CSR or it's employess and/or modirators. For official support with hardware, software pealse refer to the manufatuer. You acknowledge that opinions expressed in Content on the CSR Support System are those of contributors and modirators and does not reflect the opinions or policies of CSR Computers and/or it's employees.

4. Term and termination

These Terms will become effective in relation to you when you create a CSR Account and will remain in effect until you terminate your Account or the earlier termination by CSR thereof. You may terminate your CSR Account at any time by sending a request to support@csrcomputers.com. Without limiting its other rights to terminate access to the CSR Support System, CSR reserves the right to terminate or suspend your CSR Account at any time in case of use which, in CSR sole discretion, is in contravention of these Terms or the Guidelines. If CSR terminates or suspends your CSR Account for any reason whatsoever, CSR shall have no liability or responsibility to you. Please note that if your CSR Account is terminated by you or CSR for any reason, Content that you have posted will be kept in the CSR Support System in an anonymized form.

5. Assignment by CSR

CSR may assign its rights and obligations in connection these Terms or your CSR Account, or any part thereof, without restrictions. You may not assign your rights or obligations in connection these Terms or your CSR Account, or any part thereof, to any third party.

6. Entire agreement

These Terms together with the Privacy Policy and the Guidelines (the “CSR Terms and Guidelines”) constitute all the terms and conditions agreed upon between you and CSR and supersede any prior agreements in relation to the subject matter of these CSR Terms and Guidelines, whether written or oral. Any additional or different terms or conditions in relation to the subject matter of these CSR Support System Guidelines in any written or oral communication from you to CSR are void. You agree, and accept, that you have not accepted these CSR Support System Guidelines in reliance of or to any oral or written representations made by CSR not contained in these CSR Support System Guidelines. In the event of any conflict between the provisions of these Terms and the provisions of the Guidelines or the Privacy Policy, the provisions of these Terms shall prevail.

7. Severability

Should for any reason or to any extent any provision of the CSR Terms and Guidelines be held invalid or unenforceable, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of the CSR Terms and Guidelines and the application of that provision shall be enforced to the extent permitted by law.

8. Content Posted and Moderation

You are responsible for all tickets that you submit on the CSR Support System. CSR or other companies affilliated with CSR does not control and assumes no responsibility for such tickets submitted by other users. Any Content provided to you by CSR employees or moderators are provided on an “as is” basis without warranties of any kind.

9. Moderation

CSR reserves the right to moderate the activity on the CSR Website and CSR Support System and may remove or edit any Content for any or no reason, including, but not limited to, Content that, in CSR’s sole discretion, violates these Terms or the Guidelines. CSR may remove or edit such Content without prior notification to the responsible user.

10. No warranty

The use of the CSR Support System and/or the CSR Computers website and services is at your own risk. The CSR Support System is provided on an “as is” and “as available” basis. To the fullest extent possible under applicable law, CSR gives no warranty, express or implied, as to the quality, content and availability or fitness for a specific purpose of the CSR Support System or website. In addition, CSR does not warrant, endorse, guarantee or assume responsibility for any Content submitted on the CSR Support System or any hyperlinked website. As with any information or advice, obtained through any medium or in any environment, you should use your judgment and exercise caution where appropriate. No advice or information whether oral or in writing obtained by you from CSR or any other company of CSR shall create any warranty on behalf of CSR in this regard.

11. Limitation of liability

In no event shall CSR, or is affiliates, officers, directors, employees, licensors or any third parties be liable for any direct, indirect, incidental, special or consequential damages (including but not limited to any loss of data, service interruption, computer failure or pecuniary loss) arising out of the use of or inability to use the CSR Support System or the CSR website, even if you have advised CSR about the possibility of such loss, and including any damages resulting therefrom. Your only right with respect to any problems or dissatisfaction with the CSR Support System is to terminate your account as set out in Section 4 above and to stop using the CSR Support System. Nothing in these Terms removes or limits CSR’s liability for fraudulent misrepresentation, death or personal injury caused by its negligence.

12. Indemnity

You agree to indemnify and hold CSR, its officers, directors, employees and licensors harmless from any claim or demand (including but not limited to reasonable legal fees) made by a third party due to or arising out of or related to your violation of these Terms or the Guidelines, or your violation of any laws, regulations or third party rights.

13. Intellectual property

CSR respects intellectual property rights, and expects you to do the same. Please note therefore that the CSR Support System and website are the sole property of CSR, its licensors and is protected by intellectual property rights (including but not limited to copyright) and that you do not have a right to use the CSR Support System or website in any manner not covered by these Terms or the
